Data Collection and Purpose
Data processing is carried out in accordance with legal requirements to fulfill the treatment agreement between you and the psychotherapy practice. To this end, personal data—specifically your health data—are collected at various stages (at a minimum: at the start, during the course of treatment, and at its conclusion). This is necessary to provide psychotherapeutic treatment that meets scientific standards and to properly fulfill the treatment contract concluded with you. The collection of personal data serves solely the purpose of improving your health and is never undertaken without valid reason. Naturally, only data necessary for the psychotherapeutic treatment are collected (in accordance with the principle of data minimization). Data protection regulations, as well as the rights and obligations arising from the therapy contract, are observed and may be inquired about at any time during the course of treatment.
The data to be collected includes patient histories, diagnoses, clinical findings, proposed treatments, and records—whether prepared by us or provided by other psychotherapists or physicians (such as consultation reports, medical letters, etc.).
Saving of data
All personal data, treatment records, consultation reports, etc., are retained at the practice for at least 10 years following your last treatment appointment, in accordance with legal requirements. Your data are protected by appropriate technical and organizational systems and are available for you to request at any time.
Recipients of the data
Psychotherapists are subject to a duty of confidentiality. We only transmit your health data to third parties if permitted by law and/or if you have expressly consented to the disclosure (i.e., if you have provided a release from confidentiality).
Recipients of your personal data may include, in particular, Associations of Statutory Health Insurance Physicians (KVs), your health insurance funds, aid agencies (Beihilfe), or the Medical Service of the Health Insurance Funds (MDK). Data is disclosed—with statutory authorization—primarily for the purpose of billing for services provided to you and for clarifying medical questions or issues arising from your insurance coverage.
Should it become necessary to share your data with physicians, psychotherapists, or private medical billing agencies, a written release from confidentiality on your part is required. Similarly, no information will be disclosed to family members or others without such a release. If a legal guardianship is in place, the practice's obligation to provide information depends on the scope of that guardianship. If healthcare matters are included, there is an obligation to provide information to the legal guardian within certain limits; this would be explicitly addressed and defined during the course of therapy.
You may revoke the waiver of confidentiality. You also have the right to obtain information about your stored personal data at any time. The authority responsible for monitoring compliance with data protection regulations is the Saxony Data Protection Authority: https://www.saechsdsb.de/kontakt
The legal basis for the processing of your data is Article 9(2)(h) of the GDPR in conjunction with Section 22(1)(1)(b) of the BDSG.
What specific rights do I have as a client?
Privacy Policy
As a general rule, we process our users' personal data only to the extent necessary to provide a functional website and to deliver our content and services. Processing of our users' personal data generally takes place only with the user's consent. An exception applies in cases where obtaining prior consent is not possible for practical reasons and the processing of the data is permitted by statutory regulations.
Where we obtain the data subject's consent for the processing of personal data, Article 6(1)(a) of the EU General Data Protection Regulation (GDPR) serves as the legal basis. Article 6(1)(b) GDPR serves as the legal basis for the processing of personal data required for the performance of a contract to which the data subject is a party. This also applies to processing operations required to carry out pre-contractual measures. Where the processing of personal data is necessary for compliance with a legal obligation to which our company is subject, Article 6(1)(c) GDPR serves as the legal basis. In the event that the vital interests of the data subject or of another natural person require the processing of personal data, Article 6(1)(d) GDPR serves as the legal basis.
If processing is necessary to safeguard a legitimate interest of our company or a third party, and the interests, fundamental rights, and fundamental freedoms of the data subject do not override the aforementioned interest, then Article 6(1)(f) of the GDPR serves as the legal basis for the processing.
Data Deletion and Storage Period
The personal data of the data subject shall be deleted or blocked as soon as the purpose of storage ceases to apply. Furthermore, storage may continue if provided for by European or national legislators in Union regulations, laws, or other provisions to which the controller is subject. The data shall also be blocked or deleted upon the expiry of a storage period prescribed by the aforementioned norms, unless there is a need for continued storage of the data for the conclusion or performance of a contract.
Description and scope of data processing for the provision of the website
Each time our website is accessed, our system automatically collects data and information from the computer system of the accessing computer.
The following data are collected in this process:
• Information about the browser type and the version used
• The user's operating system
• The user's Internet Service Provider
• The user's IP address
• Date and time of access
• Websites from which the user's system reached our website
• Websites accessed by the user's system via our website
This data is also stored in our system's log files. This data is not stored together with other personal data of the user.
Legal basis for data processing
The legal basis for the temporary storage of the data and log files is Art. 6(1)(f) GDPR.
Purpose of data processing
The system’s temporary storage of the IP address is necessary to enable the website to be delivered to the user's computer. To this end, the user's IP address must remain stored for the duration of the session.
Data is stored in log files to ensure the functionality of the website.
Furthermore, we use the data to optimize the website and to ensure the security of our information technology systems. The data is not analyzed for marketing purposes in this context.
These purposes also constitute our legitimate interest in data processing pursuant to Art. 6(1)(f) GDPR.
Duration of storage
The data will be deleted as soon as they are no longer required to achieve the purpose for which they were collected. In the case of data collected to provide the website, this occurs when the respective session ends.
In the case of data stored in log files, this occurs after no more than seven days. Storage beyond this period is possible. In such cases, users' IP addresses are deleted or masked so that the calling client can no longer be identified.
Right to Object and Removal
Collecting data to provide the website and storing data in log files is essential for the operation of the website. Consequently, the user has no right to object to this processing.
Use of cookies
Cookies are used on this website. Simply put, cookies are small programs stored on the device the user employs to access this site; they collect, transmit, and analyze information regarding the user's online behavior. These cookies are not stored by the website operator but on third-party servers located outside the EU. If the user does not delete the cookies from their browser after ending the session, these cookies can be used to recognize—among other things—that the user has previously visited the site. This also allows previously selected user settings regarding the website to be restored and applied.
Information regarding the handling of cookies can also be found in the documentation for your browser; browsers typically offer options (sometimes automated) to refuse the acceptance of cookies or to have them automatically deleted—or to delete them manually—after visiting the site.
The cookies employed are also used to make the website more user-friendly. Furthermore, session cookies are used to track which subpages of this website the user has visited.
The legal basis for the use of cookies is Article 6(1)(f) of the GDPR; this serves the legitimate interests of the publisher as well as those of third parties involved with the website (e.g., server hosts or service providers)
Contact Form and Email Contact
This website features a contact form that can be used to make contact electronically. If a user avails themselves of this option, the data entered into the input fields is transmitted to us and stored. Users are informed about the data processing via a privacy notice and by providing their consent when clicking the submit button.
Alternatively, you may contact us via the provided email address. In this case, the user's personal data transmitted with the email will be stored. No data is passed on to third parties in this context, unless required by law. The data is used exclusively for processing the conversation.
Where the user has given consent, the legal basis for processing the data is Art. 6(1)(a) GDPR. The legal basis for processing data transmitted via email is Art. 6(1)(f) GDPR. If the email contact aims to conclude a contract, an additional legal basis for processing is Art. 6(1)(b) GDPR.
The user has the right to withdraw their consent to the processing of personal data at any time. In such a case, the conversation cannot be continued.

Web Analytics
Our website does not use web analytics services such as Google Analytics. Consequently, no data is collected, stored, or processed.
Rights of the Data Subject
If your personal data is processed, you are a data subject within the meaning of the GDPR, and you have the following rights vis-à-vis the controller:
Right of access
You may request confirmation from the controller as to whether or not personal data concerning you is being processed by us. Where such processing takes place, you may request information from the controller regarding the following:
(1) the purposes for which the personal data are processed;
(2) the categories of personal data concerned;
(3) the recipients or categories of recipients to whom the personal data concerning you have been or will be disclosed;
(4) the envisaged period for which the personal data concerning you will be stored, or, if not possible, the criteria used to determine that period;
(5) the existence of the right to request rectification or erasure of personal data concerning you, restriction of processing by the controller, or the right to object to such processing;
(6) the right to lodge a complaint with a supervisory authority;
(7) any available information as to the source of the data where the personal data are not collected from the data subject;
(8) the existence of automated decision-making, including profiling, referred to in Article 22(1) and (4) of the GDPR and—at least in those cases—meaningful information about the logic involved, as well as the significance and the envisaged consequences of such processing for the data subject.
You have the right to request information as to whether personal data concerning you is being transferred to a third country or an international organization. In this context, you may request to be informed of the appropriate safeguards pursuant to Art. 46 GDPR regarding the transfer.

You have the right to obtain from the controller the rectification and/or completion of personal data concerning you if such data is inaccurate or incomplete. The controller must carry out the rectification without undue delay.
Right to restriction of processing
You may request the restriction of the processing of personal data concerning you under the following conditions:
(1) if you contest the accuracy of the personal data concerning you for a period enabling the controller to verify the accuracy of the personal data;
(2) the processing is unlawful and you oppose the erasure of the personal data and request the restriction of the use of the personal data instead;
(3) the controller no longer needs the personal data for the purposes of the processing, but you require them for the establishment, exercise, or defense of legal claims, or
(4) if you have objected to the processing pursuant to Art. 21(1) GDPR and it has not yet been determined whether the legitimate grounds of the controller override your grounds.
Where the processing of personal data concerning you has been restricted, such data shall—with the exception of storage—only be processed with your consent or for the establishment, exercise, or defense of legal claims or for the protection of the rights of another natural or legal person or for reasons of important public interest of the Union or of a Member State.
If the processing has been restricted in accordance with the aforementioned conditions, you will be informed by the controller before the restriction is lifted.

Right to erasure
a) Obligation to erase
You may request the controller to erase personal data concerning you without undue delay, and the controller is obliged to erase such data without undue delay if one of the following grounds applies:
(1) The personal data concerning you are no longer necessary for the purposes for which they were collected or otherwise processed.
(2) You withdraw your consent on which the processing was based pursuant to Art. 6(1)(a) or Art. 9(2)(a) GDPR, and there is no other legal ground for the processing.
(3) You object to the processing pursuant to Art. 21(1) GDPR and there are no overriding legitimate grounds for the processing, or you object to the processing pursuant to Art. 21(2) GDPR.
(4) The personal data concerning you have been processed unlawfully.
(5) The erasure of the personal data concerning you is necessary for compliance with a legal obligation under Union or Member State law to which the controller is subject.
(6) The personal data concerning you have been collected in relation to the offer of information society services referred to in Art. 8(1) GDPR.
(1) Die Sie betreffenden personenbezogenen Daten sind für die Zwecke, für die sie erhoben oder auf sonstige Weise verarbeitet wurden, nicht mehr notwendig.
(2) Sie widerrufen Ihre Einwilligung, auf die sich die Verarbeitung gem. Art. 6 Abs. 1 lit. a oder Art. 9 Abs. 2 lit. a DSGVO stützte, und es fehlt an einer anderweitigen Rechtsgrundlage für die Verarbeitung.
(3) Sie legen gem. Art. 21 Abs. 1 DSGVO Widerspruch gegen die Verarbeitung ein und es liegen keine vorrangigen berechtigten Gründe für die Verarbeitung vor, oder Sie legen gem. Art. 21 Abs. 2 DSGVO Widerspruch gegen die Verarbeitung ein.
(4) Die Sie betreffenden personenbezogenen Daten wurden unrechtmäßig verarbeitet.
(5) Die Löschung der Sie betreffenden personenbezogenen Daten ist zur Erfüllung einer rechtlichen Verpflichtung nach dem Unionsrecht oder dem Recht der Mitgliedstaaten erforderlich, dem der Verantwortliche unterliegt.
(6) Die Sie betreffenden personenbezogenen Daten wurden in Bezug auf angebotene Dienste der Informationsgesellschaft gemäß Art. 8 Abs. 1 DSGVO erhoben.
b) Information to third parties
Where the controller has made the personal data concerning you public and is obliged pursuant to Art. 17(1) GDPR to erase the personal data, the controller, taking account of available technology and the cost of implementation, shall take reasonable steps, including technical measures, to inform controllers who are processing the personal data that you, as the data subject, have requested the erasure by such controllers of any links to, or copy or replication of, those personal data.

Art. 17 Abs. 1 DSGVO zu deren Löschung verpflichtet, so trifft er unter Berücksichtigung der verfügbaren Technologie und der Implementierungskosten angemessene Maßnahmen, auch technischer Art, um für die Datenverarbeitung Verantwortliche, die die personenbezogenen Daten verarbeiten, darüber zu informieren, dass Sie als betroffene Person von ihnen die Löschung aller Links zu diesen personenbezogenen Daten oder von Kopien oder Replikationen dieser personenbezogenen Daten verlangt haben.
c) Exceptions
The right to erasure does not apply to the extent that processing is necessary
(1) for exercising the right of freedom of expression and information;
(2) for compliance with a legal obligation which requires processing by Union or Member State law to which the controller is subject, or for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller;
(3) for reasons of public interest in the area of public health in accordance with Art. 9(2)(h) and (i) and Art. 9(3) GDPR;
(4) for archiving purposes in the public interest, scientific or historical research purposes, or statistical purposes in accordance with Art. 89(1) GDPR, insofar as the right referred to in section a) is likely to render impossible or seriously impair the achievement of the objectives of that processing; or
(5) for the establishment, exercise, or defense of legal claims.
Das Recht auf Löschung besteht nicht, soweit die Verarbeitung erforderlich ist

(4) für im öffentlichen Interesse liegende Archivzwecke, wissenschaftliche oder historische Forschungszwecke oder für statistische Zwecke gem. Art. 89 Abs. 1 DSGVO, soweit das unter Abschnitt a) genannte Recht voraussichtlich die Verwirklichung der Ziele dieser Verarbeitung unmöglich macht oder ernsthaft beeinträchtigt, oder
(5) zur Geltendmachung, Ausübung oder Verteidigung von Rechtsansprüchen.
Right to be informed
If you have exercised the right to rectification, erasure, or restriction of processing vis-à-vis the controller, the controller is obliged to communicate this rectification or erasure of data or restriction of processing to all recipients to whom the personal data concerning you have been disclosed, unless this proves impossible or involves disproportionate effort. You have the right to be informed by the controller about these recipients.
Right to data portability
You have the right to receive the personal data concerning you, which you have provided to the controller, in a structured, commonly used, and machine-readable format. Furthermore, you have the right to transmit this data to another controller without hindrance from the controller to whom the personal data was provided, provided that
(1) the processing is based on consent pursuant to Art. 6(1)(a) GDPR or Art. 9(2)(a) GDPR or on a contract pursuant to Art. 6(1)(b) GDPR, and
(2) the processing is carried out by automated means.

In exercising this right, you also have the right to have the personal data concerning you transmitted directly from one controller to another controller, where technically feasible. The freedoms and rights of other persons must not be adversely affected by this.
The right to data portability does not apply to the processing of personal data necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller.
Das Recht auf Datenübertragbarkeit gilt nicht für eine Verarbeitung personenbezogener Daten, die für die Wahrnehmung einer Aufgabe erforderlich ist, die im öffentlichen Interesse liegt oder in Ausübung öffentlicher Gewalt erfolgt, die dem Verantwortlichen übertragen wurde.
Right to object
You have the right to object, on grounds relating to your particular situation, at any time to the processing of personal data concerning you which is based on Article 6(1)(e) or (f) of the GDPR; this also applies to profiling based on those provisions.
The controller shall no longer process the personal data concerning you unless the controller demonstrates compelling legitimate grounds for the processing which override your interests, rights, and freedoms, or for the establishment, exercise, or defense of legal claims.
Where personal data concerning you are processed for direct marketing purposes, you have the right to object at any time to the processing of personal data concerning you for such marketing; this also applies to profiling to the extent that it is related to such direct marketing.
If you object to processing for direct marketing purposes, the personal data concerning you shall no longer be processed for such purposes.
In the context of the use of information society services—and notwithstanding Directive 2002/58/EC—you may exercise your right to object by automated means using technical specifications.

Sie haben die Möglichkeit, im Zusammenhang mit der Nutzung von Diensten der Informationsgesellschaft – ungeachtet der Richtlinie 2002/58/EG – Ihr Widerspruchsrecht mittels automatisierter Verfahren auszuüben, bei denen technische Spezifikationen verwendet werden.
Right to withdraw consent under data protection law
You have the right to withdraw your data protection consent at any time. The withdrawal of consent does not affect the lawfulness of processing based on consent before its withdrawal.
Automated individual decision-making, including profiling
You have the right not to be subject to a decision based solely on automated processing—including profiling—which produces legal effects concerning you or similarly significantly affects you. This does not apply if the decision
(1) is necessary for entering into, or the performance of, a contract between you and the controller,
(2) is authorized by Union or Member State law to which the controller is subject and which lays down suitable measures to safeguard your rights and freedoms and legitimate interests, or
(3) is based on your explicit consent.
However, such decisions shall not be based on special categories of personal data referred to in Article 9(1) of the GDPR, unless Article 9(2)(a) or (g) of the GDPR applies and suitable measures to safeguard your rights and freedoms and legitimate interests are in place.
In the cases referred to in (1) and (3), the controller shall implement suitable measures to safeguard your rights and freedoms and legitimate interests, which include at least the right to obtain human intervention on the part of the controller, to express your point of view, and to contest the decision.
Automatisierte Entscheidung im Einzelfall einschließlich Profiling
Sie haben das Recht, nicht einer ausschließlich auf einer automatisierten Verarbeitung – einschließlich Profiling – beruhenden Entscheidung unterworfen zu werden, die Ihnen gegenüber rechtliche Wirkung entfaltet oder Sie in ähnlicher Weise erheblich beeinträchtigt. Dies gilt nicht, wenn die Entscheidung
(1) für den Abschluss oder die Erfüllung eines Vertrags zwischen Ihnen und dem Verantwortlichen erforderlich ist,
(2) aufgrund von Rechtsvorschriften der Union oder der Mitgliedstaaten, denen der Verantwortliche unterliegt, zulässig ist und diese Rechtsvorschriften angemessene Maßnahmen zur Wahrung Ihrer Rechte und Freiheiten sowie Ihrer berechtigten Interessen enthalten oder
(3) mit Ihrer ausdrücklichen Einwilligung erfolgt.
Allerdings dürfen diese Entscheidungen nicht auf besonderen Kategorien personenbezogener Daten nach Art. 9 Abs. 1 DSGVO beruhen, sofern nicht Art. 9 Abs. 2 lit. a oder g DSGVO gilt und angemessene Maßnahmen zum Schutz der Rechte und Freiheiten sowie Ihrer berechtigten Interessen getroffen wurden.
Hinsichtlich der in (1) und (3) genannten Fälle trifft der Verantwortliche angemessene Maßnahmen, um die Rechte und Freiheiten sowie Ihre berechtigten Interessen zu wahren, wozu mindestens das Recht auf Erwirkung des Eingreifens einer Person seitens des Verantwortlichen, auf Darlegung des eigenen Standpunkts und auf Anfechtung der Entscheidung gehört.
10. Right to lodge a complaint with a supervisory authority
Without prejudice to any other administrative or judicial remedy, you have the right to lodge a complaint with a supervisory authority, in particular in the Member State of your habitual residence, place of work, or place of the alleged infringement, if you consider that the processing of personal data relating to you infringes the GDPR. The supervisory authority with which the complaint has been lodged shall inform the complainant of the progress and the outcome of the complaint, including the possibility of a judicial remedy pursuant to Article 78 GDPR.
