Data Collection and Purpose<\/h3>\n\n\n\n

Data processing is carried out in accordance with legal requirements to fulfill the treatment agreement between you and the psychotherapy practice. To this end, personal data\u2014specifically your health data\u2014are collected at various stages (at a minimum: at the start, during the course of treatment, and at its conclusion). This is necessary to provide psychotherapeutic treatment that meets scientific standards and to properly fulfill the treatment contract concluded with you. The collection of personal data serves solely the purpose of improving your health and is never undertaken without valid reason. Naturally, only data necessary for the psychotherapeutic treatment are collected (in accordance with the principle of data minimization). Data protection regulations, as well as the rights and obligations arising from the therapy contract, are observed and may be inquired about at any time during the course of treatment.<\/p>\n\n\n\n

The data to be collected includes patient histories, diagnoses, clinical findings, proposed treatments, and records\u2014whether prepared by us or provided by other psychotherapists or physicians (such as consultation reports, medical letters, etc.).<\/p>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n\n\n\n

Recipients of the data<\/h3>\n\n\n\n

Psychotherapists are subject to a duty of confidentiality. We only transmit your health data to third parties if permitted by law and\/or if you have expressly consented to the disclosure (i.e., if you have provided a release from confidentiality).<\/p>\n\n\n\n

Recipients of your personal data may include, in particular, Associations of Statutory Health Insurance Physicians (KVs), your health insurance funds, aid agencies (Beihilfe), or the Medical Service of the Health Insurance Funds (MDK). Data is disclosed\u2014with statutory authorization\u2014primarily for the purpose of billing for services provided to you and for clarifying medical questions or issues arising from your insurance coverage.<\/p>\n\n\n\n

Should it become necessary to share your data with physicians, psychotherapists, or private medical billing agencies, a written release from confidentiality on your part is required. Similarly, no information will be disclosed to family members or others without such a release. If a legal guardianship is in place, the practice's obligation to provide information depends on the scope of that guardianship. If healthcare matters are included, there is an obligation to provide information to the legal guardian within certain limits; this would be explicitly addressed and defined during the course of therapy.<\/p>\n\n\n\n

Privacy Policy<\/strong>
As a general rule, we process our users' personal data only to the extent necessary to provide a functional website and to deliver our content and services. Processing of our users' personal data generally takes place only with the user's consent. An exception applies in cases where obtaining prior consent is not possible for practical reasons and the processing of the data is permitted by statutory regulations.
Where we obtain the data subject's consent for the processing of personal data, Article 6(1)(a) of the EU General Data Protection Regulation (GDPR) serves as the legal basis. Article 6(1)(b) GDPR serves as the legal basis for the processing of personal data required for the performance of a contract to which the data subject is a party. This also applies to processing operations required to carry out pre-contractual measures. Where the processing of personal data is necessary for compliance with a legal obligation to which our company is subject, Article 6(1)(c) GDPR serves as the legal basis. In the event that the vital interests of the data subject or of another natural person require the processing of personal data, Article 6(1)(d) GDPR serves as the legal basis.
If processing is necessary to safeguard a legitimate interest of our company or a third party, and the interests, fundamental rights, and fundamental freedoms of the data subject do not override the aforementioned interest, then Article 6(1)(f) of the GDPR serves as the legal basis for the processing.

Data Deletion and Storage Period<\/strong>
The personal data of the data subject shall be deleted or blocked as soon as the purpose of storage ceases to apply. Furthermore, storage may continue if provided for by European or national legislators in Union regulations, laws, or other provisions to which the controller is subject. The data shall also be blocked or deleted upon the expiry of a storage period prescribed by the aforementioned norms, unless there is a need for continued storage of the data for the conclusion or performance of a contract.

Description and scope of data processing for the provision of the website<\/strong>
Each time our website is accessed, our system automatically collects data and information from the computer system of the accessing computer.

The following data are collected in this process:

\u2022 The user's Internet Service Provider
\u2022 The user's IP address

This data is also stored in our system's log files. This data is not stored together with other personal data of the user.

Legal basis for data processing<\/strong>
The legal basis for the temporary storage of the data and log files is Art. 6(1)(f) GDPR.

Purpose of data processing<\/strong>
The system\u2019s temporary storage of the IP address is necessary to enable the website to be delivered to the user's computer. To this end, the user's IP address must remain stored for the duration of the session.
Data is stored in log files to ensure the functionality of the website.
Furthermore, we use the data to optimize the website and to ensure the security of our information technology systems. The data is not analyzed for marketing purposes in this context.\nThese purposes also constitute our legitimate interest in data processing pursuant to Art. 6(1)(f) GDPR.

Duration of storage<\/strong>
The data will be deleted as soon as they are no longer required to achieve the purpose for which they were collected. In the case of data collected to provide the website, this occurs when the respective session ends.
In the case of data stored in log files, this occurs after no more than seven days. Storage beyond this period is possible. In such cases, users' IP addresses are deleted or masked so that the calling client can no longer be identified.

Right to Object and Removal<\/strong>
Collecting data to provide the website and storing data in log files is essential for the operation of the website. Consequently, the user has no right to object to this processing.

(4) the envisaged period for which the personal data concerning you will be stored, or, if not possible, the criteria used to determine that period;
(5) the existence of the right to request rectification or erasure of personal data concerning you, restriction of processing by the controller, or the right to object to such processing;
(6) the right to lodge a complaint with a supervisory authority;
(7) any available information as to the source of the data where the personal data are not collected from the data subject;
(8) the existence of automated decision-making, including profiling, referred to in Article 22(1) and (4) of the GDPR and\u2014at least in those cases\u2014meaningful information about the logic involved, as well as the significance and the envisaged consequences of such processing for the data subject.

You have the right to request information as to whether personal data concerning you is being transferred to a third country or an international organization. In this context, you may request to be informed of the appropriate safeguards pursuant to Art. 46 GDPR regarding the transfer.

Right to restriction of processing<\/em>
You may request the restriction of the processing of personal data concerning you under the following conditions:
(1) if you contest the accuracy of the personal data concerning you for a period enabling the controller to verify the accuracy of the personal data;
(2) the processing is unlawful and you oppose the erasure of the personal data and request the restriction of the use of the personal data instead;
(3) the controller no longer needs the personal data for the purposes of the processing, but you require them for the establishment, exercise, or defense of legal claims, or
(4) if you have objected to the processing pursuant to Art. 21(1) GDPR and it has not yet been determined whether the legitimate grounds of the controller override your grounds.

Where the processing of personal data concerning you has been restricted, such data shall\u2014with the exception of storage\u2014only be processed with your consent or for the establishment, exercise, or defense of legal claims or for the protection of the rights of another natural or legal person or for reasons of important public interest of the Union or of a Member State.\nIf the processing has been restricted in accordance with the aforementioned conditions, you will be informed by the controller before the restriction is lifted.

(1) The personal data concerning you are no longer necessary for the purposes for which they were collected or otherwise processed.\n(2) You withdraw your consent on which the processing was based pursuant to Art. 6(1)(a) or Art. 9(2)(a) GDPR, and there is no other legal ground for the processing.\n(3) You object to the processing pursuant to Art. 21(1) GDPR and there are no overriding legitimate grounds for the processing, or you object to the processing pursuant to Art. 21(2) GDPR.\n(4) The personal data concerning you have been processed unlawfully.\n(5) The erasure of the personal data concerning you is necessary for compliance with a legal obligation under Union or Member State law to which the controller is subject.\n(6) The personal data concerning you have been collected in relation to the offer of information society services referred to in Art. 8(1) GDPR.

(4) Die Sie betreffenden personenbezogenen Daten wurden unrechtm\u00e4\u00dfig verarbeitet.
(5) Die L\u00f6schung der Sie betreffenden personenbezogenen Daten ist zur Erf\u00fcllung einer rechtlichen Verpflichtung nach dem Unionsrecht oder dem Recht der Mitgliedstaaten erforderlich, dem der Verantwortliche unterliegt.
(6) Die Sie betreffenden personenbezogenen Daten wurden in Bezug auf angebotene Dienste der Informationsgesellschaft gem\u00e4\u00df Art. 8 Abs. 1 DSGVO erhoben.

b) Information to third parties\nWhere the controller has made the personal data concerning you public and is obliged pursuant to Art. 17(1) GDPR to erase the personal data, the controller, taking account of available technology and the cost of implementation, shall take reasonable steps, including technical measures, to inform controllers who are processing the personal data that you, as the data subject, have requested the erasure by such controllers of any links to, or copy or replication of, those personal data.

Right to be informed<\/strong>
If you have exercised the right to rectification, erasure, or restriction of processing vis-\u00e0-vis the controller, the controller is obliged to communicate this rectification or erasure of data or restriction of processing to all recipients to whom the personal data concerning you have been disclosed, unless this proves impossible or involves disproportionate effort. You have the right to be informed by the controller about these recipients.

Right to data portability<\/strong>
You have the right to receive the personal data concerning you, which you have provided to the controller, in a structured, commonly used, and machine-readable format. Furthermore, you have the right to transmit this data to another controller without hindrance from the controller to whom the personal data was provided, provided that\n(1) the processing is based on consent pursuant to Art. 6(1)(a) GDPR or Art. 9(2)(a) GDPR or on a contract pursuant to Art. 6(1)(b) GDPR, and\n(2) the processing is carried out by automated means.

(1) f\u00fcr den Abschluss oder die Erf\u00fcllung eines Vertrags zwischen Ihnen und dem Verantwortlichen erforderlich ist,
(2) aufgrund von Rechtsvorschriften der Union oder der Mitgliedstaaten, denen der Verantwortliche unterliegt, zul\u00e4ssig ist und diese Rechtsvorschriften angemessene Ma\u00dfnahmen zur Wahrung Ihrer Rechte und Freiheiten sowie Ihrer berechtigten Interessen enthalten oder
(3) mit Ihrer ausdr\u00fccklichen Einwilligung erfolgt.
